Terms and Conditions

General

  • All offers to supply are subject to the manufacturer’s terms and conditions.
  • Prices and specifications may change without notice.
  • All prices are ex-manufacturer’s works unless otherwise stated and are based on the price ruling at the date of despatch.

Supply of Goods Ordered

  • Orders are accepted subject to availability from the manufacturer.
  • We are not responsible for delays, loss, or damage, whether direct or consequential.
  • While we aim to match the purchaser’s exact specification, changes in design may result in similar alternatives being supplied.
  • Performance figures are based on trials and testing but are not guaranteed.
  • The purchaser is solely responsible for ensuring the goods are suitable for their intended use.

Warranties & Guarantees

  • For new goods, the purchaser must refer to the manufacturer’s warranty terms.
  • We will assist in obtaining warranty support from the manufacturer.
  • The manufacturer’s warranty covers repair or replacement of defects due to faulty materials or workmanship.
  • No liability is accepted for consequential loss, damage, or injury.
  • Warranty does not cover wear and tear, misuse, neglect, or non-genuine components.

Used Plant

  • All offers are subject to prior sale.
  • Descriptions are provided in good faith but should be verified by the purchaser.
  • Used equipment is sold “as is” with no warranty or guarantee of condition or suitability.

Part Exchange

  • Part exchange machines must be delivered in the same condition as inspected.
  • Deductions may apply if condition changes.
  • Machines must be delivered within 30 days of acceptance.
  • Any outstanding finance must be disclosed and will reduce the allowance.
  • Ownership of the part exchange machine transfers to us upon delivery.

Consequential Loss

  • We are not liable for any consequential loss or damage due to use, breakdown, or repair delays of new or used equipment.

Service Indemnity

  • We are not responsible for loss or damage to customer property while on our premises or in the care of our employees.

Prices

  • Prices quoted are current at the time of quotation but may vary.
  • Final prices are those ruling at the date of despatch.
  • VAT will be added at the applicable rate.

Deposits & Contract Formation

  • A deposit amount will be agreed upon and paid when placing an order.
  • Acceptance of a deposit does not constitute acceptance of the order.
  • A contract is only formed once the order is accepted and acknowledged in writing.

Cancellation & Non-Completion

  • If the purchaser cancels, fails to accept delivery, or does not complete the contract, the deposit will be forfeited.
  • This forfeiture does not affect our right to pursue other remedies.

Payment Terms

  • All accounts are payable in full prior to delivery unless otherwise agreed in writing.
  • Goods remain our property until full payment is received.
  • Cheques are not considered payment until cleared, unless agreed otherwise.

Hire Purchase

  • Delivery under hire purchase requires written acceptance from the hire company and payment of any balance due.

Credit & Non-Payment

  • We reserve the right to refuse orders if payment arrangements or credit status are unsatisfactory.
  • In cases of non-payment, insolvency, or liquidation, we may cancel orders or suspend delivery at our discretion.

Lien & Disposal

  • We may retain machines under lien for unpaid charges.
  • If not collected within 90 days of repair completion notice, we may sell the machine and deduct charges from the proceeds.

Delivery

  • Prices are quoted ex-manufacturer’s works unless stated otherwise.
  • Transport and carriage costs are the purchaser’s responsibility.
  • Damage in transit must be reported within 24 hours of delivery.
  • Non-delivery must be reported within 14 days of despatch.
  • Delivery to site is limited to safe hard road access.
  • The purchaser must provide labour for unloading and ensure prompt unloading.
  • Delays may incur additional charges.

Order Acceptance

  • Orders cannot be cancelled without written consent.
  • Special order goods cannot be cancelled.
  • Ex-stock orders are subject to prior sale.

Supply of Service

  • Supply of goods may include related services unless otherwise stated.

Assignment

  • Purchasers may not assign these terms or any part thereof.

Warranty of Authority

  • Our employees are not authorised to make warranties beyond those stated here.

Purchaser’s Order Form

  • Special conditions on purchaser order forms are only binding if they do not conflict with these terms.

Legal Construction

  • All contracts are governed by and interpreted in accordance with English Law.

Dennison JCB is not a lender and does not offer financial advice. We pass finance enquiries to third-party providers such as JCB Finance Limited. We are a Data Controller under the Data Protection Act 1998 and will always handle your data securely and lawfully.

By applying, you agree that we and finance providers may use your information for:

  • Administering accounts, services, and products

Note: Dennison JCB does not carry out credit searches, but our partners may do so during the quote or purchase process.

We and our partners may contact you about similar products and services unless you opt out. You can unsubscribe at any time by emailing us or following instructions in third-party communications.

  • Request a copy of the data we hold about you (a fee may apply)
  • Ask us to correct any inaccurate information
